Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the Cookember mobile application and related services (the “Service”) provided by Cookember (“we,” “us,” or “our”). By using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
If you downloaded Cookember through the Apple App Store or Google Play, the applicable app store terms, billing rules, and standard license terms also apply. These Terms supplement those store terms and do not limit any rights the stores provide you by law or contract.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) and able to form a binding contract to use the Service. By using Cookember, you represent that you meet these requirements.
2. Your Account
You sign in using Google or Apple. You are responsible for maintaining the security of the account you use to access Cookember and for all activity that occurs under your account. Signing in with a different provider using the same email address links to your existing Cookember account.
You must provide accurate information and keep your account access secure. We may refuse, suspend, or terminate access if we believe an account is being misused, compromised, used to evade limits, or used in violation of these Terms.
3. Subscriptions & Billing
- Tiers. Cookember offers a free tier with a limited monthly recipe-generation allowance and a paid Pro tier with a higher monthly allowance plus photo ingredient parsing. Current limits, subscription period, price, and included features are shown in the app before purchase and may change for future billing periods.
- Payment. Paid subscriptions are processed through the Apple App Store or Google Play and managed via RevenueCat. Charges, renewals, and refunds are subject to the terms of the applicable app store. We do not collect or store your full payment card details.
- Renewal & cancellation. Subscriptions renew automatically unless cancelled. You can manage or cancel your subscription through your app store account settings. Deleting the Cookember app or your Cookember account does not automatically cancel your paid subscription.
- Refunds. Refund requests must be handled through the Apple App Store or Google Play unless the applicable store rules or law require otherwise.
- Availability. Subscription features may be unavailable temporarily due to maintenance, outages, provider failures, store validation delays, abuse-prevention measures, or technical issues.
4. AI-Generated Content
Cookember is provided for entertainment and inspiration purposes only. Recipes, images, and ingredient suggestions are generated by artificial intelligence and should be treated as creative ideas to be considered carefully — not as professional culinary, nutritional, or food-safety guidance. We take no responsibility for the quality, accuracy, edibility, or safety of any food prepared or consumed based on the Service.
Cookember uses artificial intelligence to generate recipes, images, and ingredient suggestions. AI output may be inaccurate, incomplete, or unsuitable. You are responsible for using your own judgment before cooking or consuming anything. Always verify ingredients, quantities, cooking temperatures, and especially allergen and food-safety information. Cookember does not provide medical, nutritional, or dietary advice, and recipes are not guaranteed to be safe for any individual.
You use AI-generated recipes, images, ingredient scans, and suggestions at your own risk. Generated content may be similar to content generated for other users, may not reflect the exact ingredients or image shown, and may omit important context such as allergies, medical restrictions, spoiled food, unsafe preparation, equipment differences, local food-safety rules, or personal dietary needs.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms;
- Upload content that is illegal, harmful, infringing, or that you do not have the right to submit;
- Publish or submit content that is abusive, harassing, hateful, sexually explicit, violent, deceptive, spammy, or otherwise objectionable;
- Attempt to disrupt, reverse engineer, or gain unauthorized access to the Service or its systems;
- Abuse, automate, or circumvent usage limits or security measures; or
- Use the Service to generate content that is unsafe, abusive, deceptive, infringing, or otherwise objectionable.
6. User Content
You retain ownership of the ingredients, photos, and other content you submit. By submitting content, you grant us a worldwide, non-exclusive license to host, store, copy, process, modify for formatting, display, distribute, and create AI-generated outputs from that content as needed to operate, protect, and improve the Service, including making recipes you choose to publish visible to other users. This license continues for public recipes you choose to share unless they are removed.
You are responsible for the content you submit, publish, like, save, or report. We may review, remove, hide, de-identify, or refuse to display content at any time, with or without notice, if we believe it violates these Terms, creates risk for Cookember or other users, infringes rights, or is otherwise inappropriate. We are not obligated to monitor all content.
7. Third-Party Services
Cookember depends on third-party services, including app stores, authentication providers, AI providers, RevenueCat, diagnostics providers, and hosting/storage providers. We are not responsible for third-party services, outages, policies, billing decisions, AI model behavior, or data processing outside our control. Your use of those services may also be governed by their own terms and policies.
8. Intellectual Property
The Service, including its software, design, and branding, is owned by Cookember and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or other proprietary materials except as needed to use the Service.
9. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service, our systems, our providers, or other users. Account deletion is described on our Delete Account page. Termination or account deletion does not cancel an active app-store subscription; you must cancel subscriptions through your Apple App Store or Google Play account settings. Provisions that by their nature should survive termination will continue to apply.
10. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, available in every region, or that AI-generated content will be accurate, complete, safe, lawful, non-infringing, or reliable. You are solely responsible for decisions you make based on the Service.
11. Limitation of Liability
To the maximum extent permitted by law, Cookember will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, service interruption, personal injury, allergic reaction, foodborne illness, property damage, or any loss arising from your use of (or inability to use) the Service, including reliance on AI-generated content. To the maximum extent permitted by law, our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for the Service in the twelve months before the claim or USD $100.
12. Indemnity
To the maximum extent permitted by law, you agree to defend, indemnify, and hold Cookember harmless from claims, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising from your use of the Service, your content, your violation of these Terms, your violation of law, or your infringement or misuse of another person's rights.
13. Changes to the Service or Terms
We may modify, suspend, or discontinue any part of the Service, including features, limits, AI providers, quotas, and subscription offerings. We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
14. Discontinuation of the Service
We may decide to permanently discontinue Cookember or any paid tier. If we do, we will act reasonably toward subscribers who have paid for time they have not yet used:
- Stopping new charges. We will stop offering new subscriptions and will stop auto-renewals for the affected products, so you are not charged for a renewal period that begins after the discontinuation takes effect.
- Notice. Where reasonably practical, we will give advance notice of a permanent shutdown through the app, by email, or on our website, so you can cancel, request a refund, or save anything you need beforehand.
- Paid time already in progress. For a paid period that has already begun, we will either keep the relevant paid features available until that period ends or, where we are able to do so, provide a pro-rated refund or credit for the unused portion. Refunds and credits are processed by the Apple App Store or Google Play and remain subject to their rules, so the available remedy may depend on the store.
- Your data. Following discontinuation, we will delete or de-identify your personal data and content as described in our Privacy Policy, except for records we are required or permitted to retain.
Because subscriptions are billed by the Apple App Store or Google Play, the surest way to prevent any further charge is still to cancel your subscription in your store account settings, as described in Section 3.
15. Governing Law
These Terms are governed by applicable law, without regard to conflict of law rules, except where the laws of your country or region require a different rule. Nothing in these Terms limits consumer rights that cannot be waived under applicable law.
